Terms of Service

1 Acceptance of Terms

By creating an account, posting a listing, or browsing MNUC Market, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the platform.

These terms form a legally binding agreement between you and JBEE Creations (operator of MNUC Market), Juja, Kiambu County, Kenya.

2 Who Can Use MNUC Market

You may use MNUC Market if you are:

• A currently enrolled student at Mama Ngina University College (MNUC), Juja
• A staff or faculty member at MNUC
• A student or staff member of a nearby institution in the Juja area
• A verified external trader or vendor who has completed our outside-trader verification flow

You must be at least 18 years old to register. By registering you confirm you meet this requirement.

3 Account Registration

• You may register using your email and password, or via Sign in with Google.
• You must provide accurate information. Impersonating another student or using a fake identity is grounds for immediate ban.
• You are responsible for maintaining the security of your password. Do not share your account.
• You may only hold one active account. Duplicate accounts will be removed.
• You must notify us immediately at info@jbeecreations.co.ke if you believe your account has been compromised.

4 Our Role as a Platform

MNUC Market is a listing platform only. We connect buyers and sellers — we are not a party to any transaction between them.

• We do not own, inspect, or guarantee the quality, safety, or legality of any item listed.
• We do not handle payment between buyers and sellers (except for platform fees paid to us directly).
• We are not responsible for items that are lost, damaged, or not as described.
• Disputes between buyers and sellers are the responsibility of the parties involved.

7 Seller Agreement

By posting a listing you agree to:

• Respond to interested buyers within a reasonable time (ideally within 24 hours).
• Honour the price displayed on your listing at the time a buyer contacts you.
• Deliver the item or service as described, in the condition stated.
• Meet buyers in safe, public campus locations — the MNUC main gate is recommended.
• Not collect payment for items you are unable or unwilling to deliver.
• Not engage in bait-and-switch tactics (advertising a different item from what is sold).

External / outside traders must complete our verification flow before posting. Unverified external listings will be removed.

8 Buyer Agreement

By contacting a seller or making a purchase you agree to:

• Inspect items before transferring any money.
• Not harass, threaten, or abuse sellers.
• Report suspected scams or fraudulent listings using the in-platform report tool.
• Understand that MNUC Market does not guarantee refunds for peer-to-peer transactions.

9 Payments & Fees

• Free listings: Every account receives 1 free listing. Additional listings may require a small platform fee (currently KES 50).
• Promotion fees: Promoted listings cost KES 200/week. Fresher banner slots cost KES 500/2 weeks. Premium Seller subscriptions cost KES 200/month.
• No refunds: Listing fees, promotion fees, and premium subscriptions are non-refundable once processed via M-Pesa, except where required by Kenyan consumer protection law.
• Peer-to-peer payments: We do not process payments between buyers and sellers. Any M-Pesa transaction you make directly to a seller is entirely between you and that seller.
• Failed payments: If an M-Pesa STK push fails, do not retry manually without contacting us. Email info@jbeecreations.co.ke with your phone number and listing ID.

10 Google Sign-In Terms

If you register or log in using Sign in with Google:

• Your use of Google Sign-In is also subject to Google's Terms of Service.
• We only request your name, email, and profile photo — no other Google data.
• Revoking our Google OAuth access (at myaccount.google.com/permissions) will sign you out but will not delete your MNUC Market account. Contact us to delete your account data.

11 Strike & Suspension Policy

We operate a three-strike system for rule violations:

Severe violations (scams, fraud, prohibited items, harassment) may result in an immediate ban without prior strikes.

To appeal a strike or suspension, email info@jbeecreations.co.ke with the subject "Strike Appeal". We will review within 7 business days.

12 Intellectual Property

• By posting content (listings, photos, reviews, feed posts) you grant JBEE Creations a non-exclusive, royalty-free, worldwide licence to display, reproduce, and distribute that content solely for the purpose of operating MNUC Market.
• You retain ownership of all content you post.
• The MNUC Market name, logo, and platform design are owned by JBEE Creations. You may not use them without written permission.
• You must not post content that infringes the intellectual property rights of any third party.

13 Limitation of Liability

To the fullest extent permitted by Kenyan law:

• MNUC Market and JBEE Creations are not liable for any loss arising from transactions between buyers and sellers, including fraud, scams, or items not as described.
• We are not liable for any indirect, incidental, or consequential damages arising from your use of the platform.
• Our total liability to you for any claim arising from these terms shall not exceed the amount of platform fees you paid to us in the 30 days preceding the claim.

14 Governing Law & Disputes

These terms are governed by the laws of Kenya. Any dispute arising from these terms shall first be attempted to be resolved amicably by contacting us at info@jbeecreations.co.ke.

If not resolved within 30 days, disputes shall be submitted to the courts of Kiambu County, Kenya, which shall have exclusive jurisdiction.

15 Changes to These Terms

We may update these Terms at any time. We will notify registered users by posting a notice on the platform. Continued use after changes take effect constitutes acceptance.
